5. Object of service and warranty

5.1 A valuation prepared by Auctionata shall include a estimation of value and brief details of the item (e.g. date, material, size, artist etc.). Auctionata will make all valuations to the best of its knowledge and ability based upon the then-available information. Unless it has been otherwise expressly agreed otherwise in writing (including by email), the valuations prepared for customers shall constitute “remote valuations”. In other words, Auctionata has prepared the description without having inspected the items personally. It follows from this that the valuation constitutes a conditional and provisional estimate subject to change should Auctionata conduct a first hand valuation of the items, and that Auctionata does not, therefore, supply any definitive information about the condition.

5.2 For this reason, every item will be inspected again closely by Auctionata in the event of consignment for sale by auction or via the Online Shop. This inspection may lead to a subsequent alteration of the previously determined provisional valuation. The consignor will be notified of this as soon as practicable.

5.3 We therefore wish to expressly inform you that valuations provided by Auctionata do not constitute a formal appraisal and are not intended to be used as such. The content of a valuation, (including but not limited to a remote valuation) is used by the customer for informational purposes only. Auctionata shall assume no warranty for the valuation service(s) provided, and makes no representation or warranty that the valuation will satisfy any third party or governmental requirements for any particular purpose.
