Overview of Fees

All fees specified herein are gross prices, i.e. they include the respective applicable VAT of the country branch in Austria. All countries outside of the EU shall be considered to be non-EU member states from a tax perspective; in this case, the payment of VAT shall not be applicable.

Where required, buyers from non-EU member states must pay the duties and the taxes on the supplied services and/or goods on-site. There are exceptions to this policy. Thus, for example, the Canary Islands are considered to be a non-EU member state (known as the EU Special Zone). For entrepreneurs who make purchases from Auctionata for commercial purposes, deliveries of goods and/or services within the EU shall be exempt from the payment of VAT if the buyer can document by means of his VAT ID no. that he will pay the VAT owed in his native country.

Fees for Consignors Inhalt auf/zu

All fees for consignors shall also be contractually stipulated in the Consignor Agreement. In the event of doubt, the Consignor Agreement shall apply.

At Auctionata, you can have your first five items valuated free of charge. If you would like to have more than five objects valuated, or if you have a legacy or a collection that you would like to have valuated, you can request an estimate free of charge and without obligation. We will then let you know straightaway whether a valuation would be subject to fees or not.

If you decide to have items we have valuated sold by Auctionata, and you consign the items within one year, the valuation of these items will also be free of charge.

We always endeavour to make all costs as transparent as possible. We also promise that Auctionata will never charge fees that have not been announced in advance.

Valuation Fee Inhalt auf/zu

The valuation fee shall amount to 60.00 euros (50.00 euros plus the statutory VAT) per each 30-minute period or part thereof of the expert’s time plus 120 euros (100.00 euros plus the statutory VAT) as a lump-sum travel fee. For more than ten items, the valuation fee shall be a lump-sum amount of 2.40% (2% plus the statutory VAT) of the estimated value calculated by the expert plus 120.00 euros (100.000 euros plus the statutory VAT) as a lump-sum travel fee. The valuation of five items per year and per person is free of charge as well as the valuation for items that are supplied to the sales gallery and/or an auction within one year’s time beginning on the date of the valuation.

Supply Fee Inhalt auf/zu

In principle, this shall amount to 24.0% (20% plus the statutory VAT) of the highest bid (auction) or sales price (sales gallery) obtained, alternatively 18.00% (15% plus the statutory VAT) if the consignor himself has taken the photos of the supplied items and they meet Auctionata’s quality criteria. Alternatively, the supply fee shall amount to 12.0% (10% plus the statutory VAT) if the consignor himself has taken the photos of the supplied items and is obliged in the Consignor Agreement to store the supplied goods on his own premises, to insure them and to ship them on his own to the buyers.

Travel Costs and Out-of-Pocket Expenses Inhalt auf/zu

Additional costs and out-of-pocket expenses may be incurred if Auctionata must seek out the consignor abroad. These costs shall be contractually stipulated in the Consignor Agreement.

Transport Costs and Transport Insurance Inhalt auf/zu

In the event that, with Auctionata’s approval, the consignor ships the goods to Auctionata for an valuation, for an auction or for sale in the sales gallery, Auctionata shall assume the transport and transport insurance costs. If Auctionata ships the goods to the consignor, for example, because the consignor has rescinded the Consignor Agreement or would not like to sell any more individual items, then the consignor must assume the costs. In this case, the lump-sum packaging and shipping cost amount specified in III. 1. shall apply and shall be billed to the consignor.

The rescission fee in the event of a rescission of the Consignor Agreement before an auction and/or the placement of an item for sale in the sales gallery and/or before the lapse of the Consignor Agreement’s contractual term that has been agreed for sales in the sales gallery: Inhalt auf/zu

The rescission fee shall be 30.00% (25% plus the statutory VAT) of the agreed estimated value for the item. During an ongoing auction, after an auction bid has been accepted or after the sale of an item from the sales gallery, thus after a customer has purchased an item online, it is no longer possible to rescind the agreement.

The fee for the rescission of the Consignor Agreement after an auction and/or after the lapse of the Consignor Agreement’s contractual term that has been agreed for sales gallery sales: Inhalt auf/zu

The rescission fee shall amount to 4.8% (4% plus the statutory VAT) of the agreed estimated value of the item.

Advance Payment Interest Inhalt auf/zu

Auctionata may grant a consignor a cash advance of up to 20% of the calculated estimated value of the supplied items. If such an advance is granted and paid out to the consignor, it shall become interest-accruing at a rate of the 3-month EURIBOR (monthly average) that applies on the respective date that the cash advance is granted and shall be updated on a rolling basis respectively thereafter after three months (according to the publication issued by the Austrian National Bank) plus 6% points as a premium plus the statutory VAT p.a. (e.g. 3-M EURIBOR 11/2011 average: 1.48% + 6% premium plus 20% VAT = 8.98%) beginning on the date of payout to the consignor. The interest shall be charged to the consignor’s current account.

Transport Insurance Inhalt auf/zu

The costs for Auctionata’s transport insurance shall amount to a lump-sum amount of 3.0% (2.5% plus the statutory VAT) of the accepted bid price including the premium and/or 3.0% (2.5% plus the statutory VAT) of the sales price in the sales gallery. Purchase of transport insurance shall become mandatory if an item is purchased at an overall price of more than 500.00 euros.

Lump-Sum Packaging and Shipping Cost Amount Inhalt auf/zu

For the shipping and the packaging of items whose weight does not exceed five kilograms, whose maximum length in packaged form does not exceed 90 cm and whose maximum circumference in packaged form does not exceed 90 cm, lump-sum costs of 36.00 euros (30 euros plus the statutory VAT) shall be billed per item within the EU. If the shipping address is located outside of the EU, a lump-sum amount of 72.00 euros (60.00 euros plus the statutory VAT) shall be billed for the packaging and shipping of the aforementioned items.

For all other items, a lump-sum packaging and shipping cost amount of 144.00 euros (120.00 euros plus the statutory VAT) shall be charged per item within the EU. If the shipping address is located outside of the EU, a lump-sum amount of 240.00 euros (200.00 euros plus the statutory VAT) shall be charged per item for the packaging and shipping of such items.

Payment Default Interest Inhalt auf/zu

A buyer or a consignor shall enter into payment default if he has not rendered payment within 30 days after the payment due date; the relevant date is the date that Auctionata receives the payment into its account. In the event of payment default, the purchase price of buyers who are consumers shall accrue interest during the payment default period in the amount of 5% points above the respectively valid base lending rate (in accordance with the statutory directives published by the Austrian National Bank - per 14/12/2011, 0.38%) plus the statutory VAT. For an entrepreneur, the interest during the payment default period shall be 8% points above the base lending rate plus the statutory VAT. The interest shall be calculated per year and charged to the current account.

Storage Fee Inhalt auf/zu

The storage costs shall amount to 2.4% (2.0% plus the statutory VAT) of the estimated value of an item per each calendar month or part thereof. They shall be billed to the consignors in accordance with the Consignor Agreement. The bidders and buyers must pay the storage fees beginning on the date on which they enter into default in rendering the payment or picking up an item.

Buyer’s Premium Inhalt auf/zu

The buyer’s premium shall amount to 20% plus the statutory VAT (24.0%) of the highest bid or sales price obtained in the sales gallery. At an auction, the buyer’s premium shall be added to the accepted bid price at check-out. If a purchase is made at the sales gallery, the announced price shall include the buyer’s premium.

Cancellation fee for the cancellation of written or telephoned purchase orders up to 72 hours before an auction: Inhalt auf/zu

In principle, for the cancellation of such orders, a lump-sum expense amount of 120.00 euros (100 euros plus the statutory VAT) must be paid per item. As a rule, it is not possible to withdraw bids later than 72 hours before the beginning of an auction or during the auction. The auctioneer shall, in his own discretion, decide what exceptions will be allowed. In principle, in the event that such an exception is allowed, a lump-sum expense amount of 240.00 euros (200.00 euros plus the statutory VAT) must be paid per item.

Resale Rights Tax Inhalt auf/zu

If, in accordance with the Austrian Copyright Act, a fine arts work is subject to resale rights and the accepted bid price exceeds 3,000.00 euros, a resale rights tax must be paid amounting to a maximum of 4% of the accepted bid price.

The amount of the fee shall be regressively scaled and shall amount to the following as a percentage of the sales proceeds (without taxes):

  • From € 2,500 to € 50,000: 4%
  • From € 50,001 to € 200,000: 3%
  • From € 200,001 to € 350,000: 1%
  • From € 350,001 to € 500,000: 0.5%
  • More than € 500,000: 0.25%

The maximum limit for the resale rights tax shall be 12,500 euros per each individual sale of a work. This maximum limit shall be attained for a sales price of 2,000,000 euros.

Auctionata shall charge the buyer the corresponding amount plus the statutory VAT for the resale rights tax and properly collect such taxes.

Transport Insurance Inhalt auf/zu

The costs for Auctionata’s transport insurance shall amount to a lump-sum amount of 3.0% (2.5% plus the statutory VAT) of the accepted bid price including the premium and/or 3.0% (2.5% plus the statutory VAT) of the sales price in the sales gallery. Purchase of transport insurance shall become mandatory if an item is purchased at an overall price of more than 500.00 euros.
